Workplace Mediation In Bullying And Harassment Claims

18 Jun, 2020 | 0 comments

It’s quite unnerving that there has been such an increase in these complaints in recent years. This could be due, in part, to a rise in awareness of the importance to bring complaints, and of course the #metoo movement.

Without going into specifics – there is simply too wide a spectrum – bullying and harassment generally involve a disproportionate power dynamic coupled with a line being crossed from which there is often no return.

Sometimes, mediation can be implemented immediately, but more often than not, it can be better to hold off until after a full and fair investigation has been completed. This limits the possibility of any bias and gives everyone involved a reasonable opportunity to be heard and informed before a resolution is contemplated.

However, some workplaces don’t have an appropriate process in place. This is vital, for both sides. Any and all complaints need to be addressed promptly and on record.

Again, it’s up to the parties involved as to whether they can reconcile or need to part ways, and confidentiality is hugely important throughout the investigation process.

Have you been bullied or harassed at work or had an allegation made against you? I have. It is very stressful and can cause all kinds of other problems. How was the complaint managed for you? Do you think mediation might have helped?
