Interests and Positions: How are they different, and what should be the focus of in mediation?

Mediators (me included) repeatedly talk about how mediation is interest-based and not positional.

But what happens in high conflict situations or when participants have unconcious personality traits that prevent them from seeing their situation in any way other than purely positional?

We can reframe their positions into proposals!

Reverse interest-based negotiation is an excellent tool for time limited mediations, such as those offered for free in community justice centres and various tribunals and commissions, but also for our trial mediation service.

If you:

  • are not inclined to spend the time on a full mediation process (there can be many reasons for this);
  • have a highly positional opponent; or
  • did not quite make it to agreement in previous negotiations ..

We can help.

We don’t need to discuss the full history of your dispute. We can focus the session on proposals exchanged prior to the mediation, and help you discuss options for resolution.
