Mediation: A Quicker, Cheaper Dispute Resolution?
Worth a read..
In my experience, the legal profession generally doesn’t promote mediation as strongly as it could. I believe this is primarily due to a perceived loss of fee generation which to some lawyers outweighs the best interests of their clients. There has been some movement in the right direction in recent years, and thankfully our Courts can see the immense benefits. The process definitely assists parties to find common ground and narrow the issues in dispute, if settlement in full cannot be reached.
So the catch cry heard from mediators everywhere, for cost and time savings, is real. Mediate don’t litigate!
